VIDEO SURVEILLANCE POLICY
SC TINT SRL – TELEFERIC GRAND HOTEL
Last update: May 21, 2019
1. Legitimate Reason and Legal Basis for Video Surveillance
The use of the video surveillance system is necessary to maintain an optimal social environment and to enhance safety, security, and access control within TINT SRL premises, as required by Law no. 333/2003 regarding the security of objectives, goods, values and the protection of individuals, as well as Government Decision no. 301/2012 approving the Methodological Norms for applying Law no. 333/2003 regarding the protection of objectives, goods, values and individuals.
Legal framework:
a) Law no. 333 of July 8, 2003 on the protection of objectives, goods, values and people, with amendments and completions;
b) Government Decision no. 301 of April 11, 2012 approving the Methodological Norms of Law no. 333/2003;
c) Regulation (EU) 2016/679 of the European Parliament and Council from April 27, 2016 regarding the protection of natural persons with regard to the processing of personal data and the free movement of such data, and repealing Directive 95/46/CE (General Data Protection Regulation);
d) Instructions of the European Data Protection Authority regarding video monitoring.
2. Purpose and Scope of the Video Surveillance Policy
TINT SRL operates a video surveillance system to prevent, deter, manage, and investigate safety and security incidents, as well as for protecting individuals and property (against fires, thefts, break-ins, attacks or any other threats).
The system supports security-related objectives by monitoring specific areas and events.
It is part of the measures implemented to support security policies within TINT SRL.
The Data Controller for surveillance processing operations is the Security Department of TINT SRL.
This policy defines how the surveillance system is used and the measures applied to protect personal data and privacy of individuals located within or near TINT SRL premises.
All elements of this surveillance policy apply to all areas of TINT SRL.
3. Ensuring System Operation in Compliance with Privacy and Data Protection Legislation
3.1 System Review
TINT SRL procedures are periodically reviewed to ensure compliance with Regulation (EU) 2016/679 regarding personal data protection and freedom of data movement, repealing Directive 95/46/CE.
3.2 Compliance
TINT SRL processes images according to Regulation (EU) 2016/679 provisions.
3.3 CCTV System
The Closed-circuit television (CCTV) system may be periodically risk-assessed for each camera.
Based on assessments and with the purpose of minimizing monitoring in irrelevant areas, camera placement and viewing angles may be changed, replaced, or confirmed.
3.4 Transparency
The video surveillance policy is available and published on the TINT SRL website (www.telefericgrandhotel.ro)
3.7 Policy Review
The system operator reviews proportional use of surveillance in relation to privacy rights every two years.
During reviews, the operator evaluates if:
• the need for surveillance continues to exist;
• the system still serves its initial purpose;
• there are no better alternative solutions.
Reviews also assess whether the surveillance policy complies with laws and if it is respected in practice.
3.8 Privacy-friendly Technology
When purchasing new equipment, TINT SRL will, where possible, use optimal technologies aligned with latest industry standards.
4. Areas Under Surveillance
Camera placement and viewing angles are based on a risk analysis, ensuring camera orientation exclusively toward key areas inside the building.
Entry and exit points of the TINT SRL premises are monitored. Additional cameras monitor connection points and areas of major importance requiring enhanced security, such as cash storage areas, reception, and restricted access zones.
Areas expected to provide a higher level of privacy such as offices are not monitored. Spaces offering maximum privacy — hotel rooms, shower cabins, toilets, or similar locations — are never monitored.
Monitoring outside the TINT SRL perimeter is kept to a minimum.
5. Categories of Personal Data Collected and Purpose of Collection
5.1 Technical Characteristics
The TINT SRL video surveillance system is conventional. All cameras operate 24/7. Image quality generally allows identification of individuals within view. The system records digital images including footage, time, date, and location. We do not use advanced analytics, audio recording, or smart surveillance technologies, and the system is not interconnected with other systems.
5.2 Purpose of Video Surveillance
The system ensures safety, security, and access control.
It monitors and protects buildings, staff, tourists, and visitors, including assets and documents stored inside.
It supports prevention, investigation, and management of physical security incidents or unauthorized access attempts, including IT infrastructure areas.
5.3 Purpose Limitation
The system is not used for other objectives beyond those stated.
It is not used to track employee attendance and not as an investigation tool except for safety/security incidents.
Recordings may be provided to authorities during disciplinary or criminal investigations.
5.4 Webcams
TINT SRL does not use webcams for safety/security purposes.
5.5 Special Data Categories
The CCTV system is not intended to collect special categories of personal data (ethnicity, religion, political views, health, sexual orientation, etc.).
However, recordings may unintentionally capture individuals with disabilities (wheelchair users, visually impaired persons using ramps).
Monitoring covers only the minimum necessary area for safety purposes.
Staff authorized to operate surveillance receive data protection training.
6. Access Rights and Data Beneficiaries
6.1 Internal & External Security Staff
Surveillance operations are managed internally.
Footage is accessible only to designated TINT SRL employees on a need-to-know basis.
Recordings may only be disclosed to police, prosecutors, or courts upon official request.
System maintenance is provided by an external contractor under security supervision.
6.2 Right to Access Personal Data
TINT SRL maintains documentation specifying who may access recordings, under what conditions, and with which rights. Designated personnel may be authorized to:
• view live camera feeds
• view recorded footage
• copy footage
• download footage
• delete footage
• modify footage
Access levels are defined through official internal decisions.
6.3 Staff Training
All persons with access rights, including security agents and technicians, receive training regarding personal data protection.
6.4 Confidentiality Agreements
All personnel with access rights sign confidentiality agreements prohibiting sharing or showing footage to anyone other than authorized recipients.
6.5 Transfers & Requests
Data gathered through surveillance may only be shared with law enforcement for criminal or disciplinary investigations, and only on request — no routine transfers occur.
7. Data Protection Measures
To protect the surveillance system and personal data, technical and organizational safeguards are applied.
Se iau toate măsurile posibile, tehnice și fizice, pentru a asigura securitatea sistemului și asigurarea protecției datelor, printre altele:
• confidentiality and non-disclosure agreements for all staff (internal & external)
• limited access based on necessity
• maintenance of updated access control records
8. Data Retention
Recordings are stored for 20 days.
If footage is required for investigations, it may be stored longer — up to 1 year when archived as case evidence.
9. Public Information
The public is informed through a multilayer approach:
• on-site signage (entry, perimeter, reception)
• a summary available at hotel reception
• full policy published on the official website
10. Rights of Access, Rectification, and Erasure
Individuals have the right to access or request correction/deletion of personal data.
